The purpose of this privacy policy (hereinafter “Privacy Policy”) is to describe how the website currently available at www.winefully.it (hereinafter “the Website”) is managed with regard to the processing of personal data of users/visitors (hereinafter “the User” who access/consult it).

This information is provided – pursuant to Article 13 of EU Regulation 679/2016 of April 27, 2016 (on the protection of individuals with regard to the processing of personal data) – to those who connect to the Site.

The Site is owned by Winefully S.r.l. (hereinafter “Winefully” and the Privacy Policy is rendered only for the Site not also for other websites or sections/pages/spaces owned by third parties, possibly consulted by the User through appropriate links or similar tools. Where the User selects one of the aforementioned links, he/she gives his/her consent to the transfer of his/her personal data to the operators of said websites or sections/pages/spaces.

Users are invited to read this Privacy Policy carefully before submitting any kind of personal information and/or filling in any electronic form on the Site.

The computer systems and software procedures used to operate this Site acquire, in the normal course of operation, some personal data that are transmitted implicitly in the use of Internet communication protocols.

This is information that by its nature could, through association operations with data held by third parties, allow to identify Users (e.g. IP address, domain names of computers used by Users who connect Site, etc.).

Where the User decides to create and manage its own account on the Site, Winefully may process the following categories of personal data: first name, last name, billing and shipping address, payment method username and e-mail address.

The aforementioned data will be collected and processed to enable the User to access the restricted area on the Site and take advantage of the services offered by Winefully on the Site. 

This is data strictly necessary for the creation of the account on the Site, which will be retained by Winefully until the cancellation of the account by the User or, if earlier, by the same Winefully, except where it is necessary to extend the storage period for the purpose of fulfilling legal obligations or for the protection before the competent authorities of the rights of Winefully.

Where the User decides to proceed with the purchase of a product offered for sale on the Site, Winefully may process the following categories of personal data: first name, last name, company name (where applicable) billing and shipping address, telephone number, email address, data relating to the purchase made (type of product purchased, transaction amount, order number and notes to the order), payment method selected.

The aforementioned data will be collected and processed to enable the User to conclude the purchase contract and for the proper fulfillment of obligations, including tax obligations, related to the same.

This is data strictly necessary for the purchase of products offered on the Site, which will be retained by Winefully for a maximum term of 10 years from the conclusion of the purchase, except where it is necessary to extend the storage period for the purpose of fulfilling legal obligations or for the protection before the competent authorities of the rights of Winefully.

In the case of payment through the PayPal, Masterpass or credit card, Winefully will not process in any way the data related to the means of payment (such as credit card number or associated bank account, holder, expiration date and security code c.d. CVC, or other codes that may be required) which will instead be acquired by the provider of the payment service and who will act as an autonomous data controller.

 

Where the User decides to subscribe to the Site’s newsletter, it may process the following categories of personal data: email address.

The aforementioned data will be collected and processed to enable the User to receive the Site’s newsletter.

This data is strictly necessary to send the User the newsletter and will be retained until the User or, if at an earlier time, Winefully itself requests/disposes of its deletion, except in cases where an extension of the storage period is necessary for the purpose of fulfilling legal obligations or for the protection before the competent Authorities of Winefully’s rights.

With the specific consent of the User, Winefully may also process the data voluntarily provided by the same when registering to the Site or making a purchase for direct marketing activities, to elaborate studies, research, market statistics; send advertising and informative material; carry out direct activities of sale or placement of products or services; send commercial information; carry out interactive commercial communications.

For the processing of data preordained to the performance of direct marketing activities, it is mandatory to acquire the consent – specific and separate – from the User, who is as of now informed that such conferment is entirely optional and any refusal will not result in any consequence (except to prevent the processing of data aimed at direct marketing).

The data processed for direct marketing purposes will be kept for a period of 24 months from the communication of the same and from the provision of consent to their processing, without prejudice to the possibility for Winefully to request the renewal of consent to the processing of the aforementioned data or the case in which an extension of the storage period is necessary for the purpose of fulfilling legal obligations or for the protection before the competent Authorities of Winefully’s rights.

 

With the specific consent of the User, Winefully may process the data voluntarily provided by the same during registration to the Site or when making a purchase for profiling activities of the User, that is, the analysis of the User’s purchasing preferences and consumption habits, through the detection of data such as the frequency or type of purchases made. Said processing is aimed at sending the User advertising material or personalized commercial and promotional communications by Winefully.

For the processing of data preordained to the conduct of profiling activities, it is mandatory to acquire the consent – specific and separate – from the User, who is as of now informed that such conferment is entirely optional and any refusal will not result in any consequence (except to prevent the processing of data aimed at profiling the User).

The data processed for direct marketing purposes will be kept for a period of 12 months from the communication of the same and from the provision of consent to their processing, without prejudice to the possibility for Winefully to request the renewal of consent to the processing of the aforementioned data or the case in which it is necessary to extend the storage period for the purpose of fulfilling legal obligations or for the protection before the competent Authorities of the rights of Winefully.

 

Where the User decides to contact Winefully directly using the contact details on the Site Winefully may process the data voluntarily provided by the same for the sole purpose of providing its response to the requests received.

Where the request is related to an order placed by the User, the data provided will be processed in order to fulfill the obligations related to the contract of sale of the product.

Where the request is not related to an order placed by the User, the latter by transmitting his communication to Winefully gives his consent to the processing of the data provided for the purposes mentioned above.

For the processing of data preordained to respond to requests received, the User is as of now informed that such conferment is entirely optional and any refusal will not result in any consequence (other than to prevent Winefully the possibility of providing feedback to the User).

The data processed in order to fulfill the requests transmitted by the User will be kept for the time strictly necessary to provide the requested response, without prejudice to the possibility for Winefully to request the renewal of consent to the processing of such data or the case in which it is necessary to extend the storage period for the purpose of fulfilling legal obligations or for the protection before the competent authorities of the rights of Winefully.

 

The processing of personal data will be carried out in a lawful manner and in accordance with fairness and in any case in accordance with the above-mentioned legislation, by means suitable to ensure the security and confidentiality and can also be carried out through computer tools designed to store, manage and transmit the data.

The processing will be carried out, in the main, by the company’s internal organization – through the appointed and duly authorized company functions – under the direction and control of Winefully and for the purposes indicated.

 

Without prejudice to the communications made in fulfillment of an obligation of law, regulation or national or European Union legislation, the communication, even by mere consultation or making available of personal data concerning Users may take place to the following subjects:

(a) entities, supervisory bodies, authorities or public institutions;
b) individuals or legal entities that provide specific services: data processing, logistics and postal services, legal, administrative, tax and/or accounting advice, organization of fairs and communication events;

In any case, to the aforementioned subjects are transferred exclusively, if not aggregated personal data and in anonymous form, the personal data necessary and relevant to the purposes of the processing to which they are assigned.

 

Winefully, in accordance with the provisions of Art. 12 GDPR expressly reminds Users of the right to access personal data (provided by Art. 15 GDPR) as well as the rights provided by Articles 16, 17, 18, 21 GDPR regarding rectification, cancellation, restriction and opposition to processing.

It should be noted that any rectification or erasure or restriction of processing carried out at the request of Users, unless this proves impossible or involves a disproportionate effort, will be communicated by Winfeully to each of the recipients to whom the personal data were transmitted.
